Refund & Cancellation Policy

LUXXO offers fair and transparent refund and cancellation terms to protect our customers.

1. Refund Before Digital Signature

The Buyer is entitled to cancel the transaction and receive a full refund of deposited funds (less any non-refundable third-party payment processing fees) only if:

  1. The cancellation occurs before the Purchase Agreement has been digitally signed by both parties on the LUXXO Platform (ESIGN Act).
  2. The platform detects an insurmountable identity verification (KYC) failure.

2. Post-Signature Irrevocability (Fund Release Protection)

Once the Purchase Agreement has been digitally signed by the Buyer and the Dealer on the LUXXO Platform, the transaction is considered legally binding under the ESIGN Act. At that time, LUXXO is irrevocably authorized to send the instruction to release the funds held by Stripe to the Dealer.

  • No Refunds from LUXXO: After signing, LUXXO will not process refunds or cancellations. Any dispute related to the vehicle, its condition, or the Dealer’s failure to deliver must be resolved directly between the Buyer and the Dealer, outside of the LUXXO Platform, in accordance with the terms of the Purchase Agreement.
  • Released Funds: If the funds have been released to the Dealer (which is the Merchant of Record), any refunds or compensation are the sole responsibility of the Dealer.

3. Refund Process and Timeframe

All authorized refunds will be processed by Stripe, Inc. and are subject to Stripe’s bank processing times, generally 5 to 10 business days. LUXXO is not responsible for delays in third-party refund processing.

4. Reservation Cancellation (Within 72 Hours)

  • Full refund of deposit if cancellation is made within 72 hours and no legal/transport procedures have begun.
  • Refund processed within 7 business days to original payment method.

5. Late Cancellation (After 72 Hours)

  • A 15% administrative fee applies if cancellation occurs after 72 hours or once documentation/logistics are initiated.

6. Cancellation by LUXXO or Dealership

  • Full refund if cancellation is due to vehicle unavailability or legal inconsistencies.
  • Refund processed within 10 business days.

7. Right of Withdrawal (U.S. Residents)

  • If legally applicable, the buyer may withdraw within 7 days of receiving the vehicle if:
  1. The car has not been titled.
  2. It remains unused and in original condition.
  • Return shipping costs are paid by the customer unless LUXXO or the dealer is at fault.

8. Refund Procedure

To request a refund:

  • Include your order number and reason for cancellation.
  • LUXXO will evaluate and respond within 5 business days.

9. Non-Refundable Situations

No refunds will be issued if:

  • Buyer changes their mind post-delivery without valid reason.
  • The vehicle has been used, altered, or damaged.
  • Contract terms were violated by the buyer.
